Regular Promotion of the officiating JTOs.

BSNLEU is continuously persuing this case. The case is being processed in the Corporate Office. We hope that the final order will be issued by the end of March 2014, for the regular JTO promotion of around 1800 officiating JTOs. 

Latest developments regarding FR22 (1)a(1)

Today there is a call from Corporate office New Delhi Establishment Section regarding implementation of  FR22(1)a(1), Contempt case filed at PCAT New Delhi againast CMD BSNL and others regarding implementation of the Judgement in OA 1282/2010 filed by BSNL Officers Associtaion and N.Kabeerdas. Same was discussed with our Central Coordinator and requested to withdraw the Contempt case against CMD BSNL and others. Our Central Coordinator positively responded and said that if the orders are released we will close the contempt case. After one hour the orders are kept in Corporate Intranet and again they called our Central Coordinator for closing of Contempt case. As per this order which was kept below is not fully clear. For all Officiating JTOs implementation is not mentioned any where. For clarifications and for further necessary steps Central Cordinator is going to Delhi. To meet the all the Senior Officers, Leaders of the Union/Associations and our Legal Consultant at Delhi our core committee is planning to visit Delhi immedeately for speeding up our issue.  All the State Coordinators are requested to conduct the meeting at SSA level and explain to each member about the current position and necessity of collecting Legal Fund at this final juncture. All State Coordinators are requested to support CHQ financially as early as possible to meet the expenditures in future course of action. Latest developments regarding our Regularization issue

Today our Central Coordinator spoken with the Senior Officers in the Establishment section regarding our issue. As per the committee report they are preparing the minutes for sending to Legal section and for taking the opinion from Unions/Associations. After completion of this task it will be sent for Management Committee Approval and finally for Board Approval.

The process is running very slow. To meet the all the Senior Officers, Leaders of the Union/Associations and our Legal Consultant at Delhi our core committee is planning to visit Delhi shortly for speeding up our issue. The program will intimated after the steering committee meeting on today at Hyderabad. All the State Coordinators are requested to conduct the meeting at SSA level and explain to each member about the current position and necessity of collecting Legal Fund at this final juncture. All State Coordinators are requested to support CHQ financially as early as possible to meet the expenditures in future course of action. Meeting with GM(Estt):

GS, President and AGS Arvind Dahiya met Sri R. K. Goyal GM(E) on 27.12.13 and discussed the regularization of officiating JTOs, issuing necessary clarification to the Circles regarding the seniority of the JTO candidates who passed the LICE for different vacancy year, onetime measure or special recruitment of JTOs to North East Circle and J&K, proposed amendment to the JTO Rect rule, next LICE from TTA to JTO etc. Assn had some fruitful discussions on the proposed amendment to the JTO RR. GM(E) assured that after the proposed amendments are ready, it will be circulated among the Unions/Associations for their comments. As reported earlier it is proposed to amend the RR as a onetime measure reserving certain percentage of vacancies for the officiating JTOs to make the TTAs passed the qualifying exams in 1999, 2000, 2001 etc as per JTO RR 1966 automatically eligible for JTO rect. 

This was the original proposal of this Association since 2004 to make them JTOs as a onetime measure by amending the RRs but it took 8 years due to conflicting demands and all of them lost precious 8 years service. On special recruitment to tenure Circles, GM(E) assured to explore the possibilities.

Support CHQ for the future course of action

The Core Committee is planning to go to Delhi shortly to meet all the Senior Officers of the BSNL Management, All Associations / Union Leaders and our Legal Consultant at New Delhi regarding our Regularization Issue.

All the State and SSA coordinators are requested to conduct the SSA level meetings and raise the Legal fund and support CHQ to meet the future course of action and Legal expenditure regarding our Regularization and Implementation of FR22 (1)a(1) for all the Officiating JTOs through out India from 2005.

Latest Position of PCAT case

MA for reserving the JTO posts for all Officiating JTOs through out the country as per verdict given by The Honorable Judge in the PCAT New Delhi Case OA 1467/2013, MA 1333/2013 is originally listed on 19-12-2013. The Management requested time for collecting some data from the field units and for submitting the Affidavit. Due to this reason the case is listed for hearing on 21^st Feb 2014.

Today our General Secretary spoken with Sri Chandeswar Sing GS NFTE, Sri P.Abhimanyu GS BSNLEU regarding National Council Meeting details and our Regularization Issue. They told that though it was not officially notified, the management is under the process of Regularization. 

Our General Secretary spoken with Sri Prahlad Rai GS AIBSNLEA regarding our issue. He told that as per GM (Estb) after one more meeting the committee will send the approved report to MC. After MC approval this will go to Board Meeting for approval.

 Regularization of Officiating JTO’s: We requested to expedite the process of regularization of officiating JTOs. GM (Estt) mentioned that the Committee Constituted to amend the JTO RR-2001 has prepared the minutes of the earlier meeting and shortly in the next committee meeting JTO RRs will be finalized. And shortly the same will be sent to BSNL Management Committee for clearance and thereafter to BSNL Board for approval. However, he assured an early action in this regard.

AP High Court case status

The Writ Petition (WP 37556/2013, WP MP 46735/2013) filed by BSNL Management in AP High Court against CAT Hyderabad Bench Judgment regarding reserving the JTO posts for Officiating JTOs is heard on 23-12-2013.  BSNL management (Petitioner) side Advocate Smt MSP Sarada and Senior Advocate, Respondent side Advocate Smt Jyothi Eswar Gogineni and Senior Advocate Sri R.Subbaiah and caveat side Advocate Sri Durga Prasad attended the court. After some arguments Hon’ble Judges Sri R. Subhash Reddy and Sri A.Shankar Narayan asked respondent to submit the Counter Affidavit and passed the order till that time Status co will be maintained. Our Association side Sri N.Kabeerdas and Sri Y.Ramakrishna Rao attended the court and discussed with our advocate and Senior advocate after the hearing.

Emergency General Body meeting of Hyderabad SSA

HTD SSA members Emergency meeting was held at BSNL Bhavan, Hyderabad on 20-12-2013. They discussed about the latest developments and passed the following resolutions.

1)   Court cases status at Hyderabad and Delhi.

2)   Discussed elaborately the points relating to WP No 37205/2013 , OA No 600/2013 filed by BSNL Management against the CAT Hyderabad Bench Judgment regarding reserving of posts to Officiating JTOs in Hon’ble High Court of Andhra Pradesh, Hyderabad. This case is listed for hearing on 23-12-2013.

3)   Contact each and every OJTO with 3 to 4 active members and explain the latest developments and collect the Legal Fund for future course of action.

Central Coordinator contacted Sri Sampath Rao CS BSNLEU and discussed about the National Council Meeting and next spell of Officiating arrangement in AP.

Regularization of officiating JTOs: GS, Jt Sec(S) and AGS met Sri R K Goyal, GM(Estt) and held discussions on the issue. As creation of supernumerary posts is having reservation for the legal section, BSNL formed a committee to propose amendments in the JTO RR 2001 in order to make the officiating JTOs who passed the qualifying examination held in 1999/2000/2001 eligible for promotion as JTO without any further examination. The Committee met once and in another one or two sittings they will make their recommendations to the management.

Latest position of PCAT case regarding our reserving the posts for Officiating JTOs and BSNL National Council Meeting

 MA for reserving the JTO posts for all Officiating JTOs through out the country as per verdict given by The Honorable Judge in the PCAT New Delhi Case OA 1467/2013, MA 1333/2013 is originally listed on 19-12-2013. But due to non submission of Affidavit by BSNL Advocate it is learnt that the case may not be heard on 19-12-2013 it will be postponed to a nearest date.

National Council is going to be held on 23-12-2013. Our issue is not listed in the National council agenda Staff side published by the BSNL CO. Where as our issue is listed in the 10^th point in agenda submitted by NFTE and 11^th point in the agenda submitted by BSNLEU. Our Central Coordinator is seriously pursuing with the Leaders of BSNLEU and NFTE for putting pressure to include our point.

Support CHQ for all the future course of actions and Legal Fund

The Core Committee is planning to go to Delhi shortly to meet all the members of the Management Committee, JTO RR 2001 amendment Committee for Regularization of Officiating JTOs, All Associations / Union Leaders and our Legal Consultant at New Delhi.

All the SSA coordinators are requested to conduct the SSA level meetings and raise the Legal fund and support CHQ to meet the future course of action and Legal expenditure regarding our Regularization and Implementation of FR22 (1)a(1) for all the Officiating JTOs through India from 2005. 

Latest position of Regularization of Officiating JTOs

AS per GM (Estt) for Regularization of Officiating JTOs by amending JTO RR 2001 the committee meeting was held on 17-12-2013 with its members CGM (NTP) New Delhi, PGM (EW) and GM (F) BSNL CO to modify JTO RR 2001 and apprised that the committee will submit its report shortly regarding this.

AP Circle Emergency Meeting at Vijayawada

AP Circle SSA coordinators and active members emergency meeting was held on 15-12-2013 at Club Room, Office of DGM STSR, Vijayawada and the following resolutions were passed.

1)  One Core Committee has been formed with 7 members from AP in addition to Circle Coordinators to work in all aspects to speed up our long pending, legitimate Regularization issue.

2)  Legal fund has to be raised by 31-12-2013 for supporting CHQ to meet the future expenditure regarding Implementation of FR22 (1) a (1) for all Officiating JTOs from 2005 and Regularization of Left out Officiating JTOs and Qualified and Trained TTAs.

3)  All Circle and SSA coordinators are requested to consult each and every member and explain the latest developments and necessity of Legal Fund collection as early as possible.

4)  Don’t Trust rumors unless the message received from CHQ.

5)  Once again our Regularization is delayed by rejecting the Supernumerary option and decided to Regularize by amending the JTO RR 2001.

6)  With in a short period the core committee will proceed to Delhi to resolve our long pending issue through different sources as early as possible. They will meet all the Union/Association Leaders for getting their support in amendment of RRs.

7)  The meeting decided to work on this issue seriously  without any delay and  try to resolve our issues by Feb 2014.

13.12.2013: GS and AGS (HQ) met GM (Estt.) and discussed

1. Regularization of Officiating JTOs: We requested for early action to regularize Officiating JTOs. GM (Estt) mentioned that a committee has been constituted to consider the Recruitment Rules of the JTOs by amending JTO RR 2001. He assured that shortly the committee meeting will be hold and thereafter taking the comments from Unions/Associations, the JTO RR will be modified which will be placed before the Management Committee and BSNL Board for approval. He opined that this process may take 2-3 months time and there after regularization of the Officiating JTOs will take place.

Latest Position of Regularization issue

Our Central Coordinator continuously perusing our Regularization issue with the Management and Unions / Associations. It is learnt that the draft is prepared for the Regularization  of officiating JTOs by Amending JTO RR 2001 and shortly it will be sent to Management Committee for discussion and approval.

FR22 (1)a(1) Contempt Petition COCP MA 515/2013, OA 1282/2010 status:

FR22 (1)a(1) Contempt Petition COCP MA 515/2013,  OA 1282/2010  status: BSNL advocate not  appeared to the Court today. Hon’ble Judge posted the case on 09-01-2014 and said that if the BSNL advocate again fails to appear on that day he will pass the order as per the plea in MA.

Hyderabad Telecom Officiating JTO Sri L.Pandarinath got 2^nd Rank in HIT performance Report and awarded by PGM HTD. JTO (O) BSNL India congratulate Sri L.Pandarinath for the achievement and to work with the same spirit in future also.

They said that proposal for Regularization through Supernumerary posts creation is rejected by Legal Section and advised to amend the JTO RRs 2001 for one time Regularization of the Officiating JTOs. Now that proposal is sent to Director HR for approval and further MC and Board of Directors Approval.

The demand of BSNLEU, that all the Officiating JTOs should be given regular JTO promotion was accepted by the Management in the talks held on 18-10-2013. This issue is also being actively processed by the Corporate Management. CHQ is also pursuing this case and will ensure early releasing of the order.

Brief Note on pending issues which needs immediate settlement

Regularization of offg. JTOs: Hon'ble High Court of Punjab & Haryana at Chandigarh was pleased enough to close the Contempt of Court case COCP 1431/2008 against CMD BSNL & others filed by some petitioners in WPC 5608/2007 in the matter of diversion of DR quota JTO vacancies. The counsel for contempt petitioners have chosen to withdraw the contempt petition and the high court has been pleased to dispose of the contempt petition on his statement. No adverse observation with account to supernumerary posting of Officiating JTOs have been made by the court virtually accepting the stand of BSNL to adjust earlier qualifying test offg. JTOs.

We requested Estt. Section for taking an early action regarding regularization of Offg. JTOs. BSNL's advocate, Haryana Circle Sh. Amit Rathi’s legal opinion has been received in BSNL C.O., Estt. Section, wherein, BSNL can create super-numeric posts of JTOs for Regularization and the same has again been sent to BSNL C.O. legal cell for its concurrence but the legal cell did not agree to create further super-numeric posts since sufficient JTOs posts are laying vacant. Hence, legal cell has advised to amend the JTO RRs -2001. It needs an early action.

Both the cases pending at PCAT New Delhi are re scheduled as below.

1)  MA for reserving the JTO posts for all Officiating JTOs through out the country as per verdict given by The Honorable Judge in the PCAT New Delhi Case OA 1467/2013, MA 1333/2013 is listed on 02-12-2013.

2)  PCAT New Delhi FR 22 (1)a(1) contempt case: MA filed by our Central Coordinator  for implementation of FR 22 (1)a(1)  benefit to all the Officiating JTOs from 2005 is listed  on 09-12-2013.

We hope that suitable directions will be given to the BSNL Management in both the cases. Regarding our Regularization issue our central coordinator perusing with all the UNION / ASSOCIATION leaders and with the Management continuously. The discussions are still going on between Director HR, GM (Estb) and GM (Legal) regarding creation of Supernumerary Posts and its implications. This issue will be resolved soon as per the higher authorities.

Our UP delegation met SNEA GS and President at Kanpur

Sri Srivasthava, Sri Pande and other Officiating JTOs delegation attended General Body Meeting of SNEA at Kanpur. Our delegation met Sri Sebastian and Sri Jogi of SNEA and discussed about our Regularization issue.

Dear Friends our Association is continuously perusing the issue Regularization of Officiating JTOs through Supernumerary post. As per BSNL Council Sri Anil Rathee’s Legal advice the case is already referred to Legal Section for approval. Legal section wants some clarification regarding creation of Supernumerary posts and further implications on the issue. Director HR is arranging a meeting with GM (Estb) and GM (Legal) for discussing about the issue. After the Meeting a decision will be taken on our Regularization issue.

Mean time Our Central Coordinator filed MA for reserving the JTO posts for all Officiating JTOs through out the country as per verdict given by The Honorable Judge in the PCAT New Delhi Case OA 1467/2013, MA 1333/2013 about reserve the Officiating JTO vacancies. This case is posted on 19-12-2013 for hearing.

Further there is no need for filing the Court cases here and there, because already Judgment is released but for clarity and implementation of the judgment our Central Coordinator filed MA. We hope that verdict will be given shortly.

Some OJTOs are breaking our unity by sending SMS/MAIL and collecting money for court cases and Regularization etc. Don’t believe any rumors unless there is an information by our Central Coordinator or from our blog. Be united our problem will be resolved shortly.

We are trying for Regularization of all Officiating JTOs but not concentrating on other issues which are not concerned for us.

Details of Our delegation tour to AIBSNLEA 4th AIC at Nashik

The 4^th All India Conference of AIBSNLEA held at Sapkal Knowledge Hub, Kalyani Hills, Anjeneri, Nashik, Mahrashtra from 10-11-2013 to 12-11-2013.

Our Officiating JTO’s delegation from MH, AP and Kerala attended the meeting. The delegation also discussed our issue elaborately with Sri J.Saibaba CS AP AIBSNLEA, Sri V.P.Kulkarni CS MH AIBSNLEA and Sri Mangalanandan CS Kerala AIBSNLEA. Our AP delegation personally met CMD BSNL along with our Central Coordinator Sri N.Kabeerdas. Our OJTO delegates from MH and Kerala Circle are also seriously discussed about our Regularization issue in the AIBSNLEA AIC Delegates Meeting on 10-11-2013.

The Open Session of Conference was held on 11-11-2013. In the Open session Sri Prhlad Rai GS AIBSNLEA highlighted our issue Regularization of Officiating JTO’s. The Open session is addressed by President and General Secretary of AIBSNLEA, General Secretaries of Unions/Associations, Senior Officers of BSNL at last CMD BSNL.

During the lunch Break our Central Coordinator Sri N.Kabeerdas along with Sri Prahlad Rai GS AIBSNLEA and Sri Venugopal President AIBSNLEA met  Sri R.K.Upadyaya CMD BSNL, Sri Pillai Director Finance BSNL, Sri N.K.Gupta Director CFA and Sri Neeraj Verma Sr. GM SR and discussed personally about our issue.

In the AIBSNLEA AIC delegate session at 1830 Hrs on 11-11-2013  our Central Coordinator Sri N.Kabeerdas addressed the gathering regarding Regularization of Officiating JTO’s and Implementation of FR22 (1) a (1) for all the OJTO’s since 2005 and also given dead line for the Regularization of Officiating JTO’s by December 2013.

Sri Parnerkar and other MH Circle OJTO’s are effectively involved in the AIBSNLEA AIC arrangements. We once again thanks to Sri Prahlad Rai and MH Circle Reception Committee.

Regularisation of Offg. JTOs: We requested for taking an early action regarding regularization of Offg. JTOs. GM(Estt.) mentioned that the legal opinion from BSNL C.O. Legal Cell has been  received but it needs some discussions on creation of supernummery posts of JTOs which will take place shortly with Sr. GM(Legal) in the presence of Director(HR), BSNL Board to short out the issue. However, he assured an early action.

Latest position of our Regularization Issue

Our Central Coordinator contacted senior Officers in Corporate Office regarding our Regularization issue. They told that note is received from Legal Section. A meeting will be conducted by GM (Estb) shortly for discussion with  GM(Legal) and Director HR about the creation of Supernumerary Posts. After that this will sent for Management Committee approval and then Board of Directors approval. They further assured an early action in this regard.
