Our Cases status at New Delhi PCAT

Case OA 1467/2013, MA 1333/2013 about reserve the Officiating JTO vacancies is posted on 24-10-2013. But as on date BSNL Management not filed counter affidavit. As per our Advocate information the case may not be heard on 24-10-2013 and will be posted on another date for final hearing.

FR 22 (1)a(1) contempt MA  for implementation to all the Officiating JTOs from 2005 is filed by BSNLOA. It is listed on Yesterday and posted for hearing on 28-11-2013.

Support CHQ

All state and SSA Coordinators are requested to support to strengthen the Financial position of CHQ for the continuous perusal of our Regularization and FR22 (1) a (1) issues at all the levels. By our Sincere efforts with the support of all Officiating JTOs through out the Country our issue is in a final state. So Please support the CHQ for taking any further necessary steps to speed up our issues.

MH Circle case status regarding Regularization of Officiating JTOs

Sri S.W Parnerkar and other Officiating JTOs of MH Circle filed case for Regularization. BSNL Advocated requested 4 weeks time for filing the reply and 2 weeks given to petitioners  to submit rejoinder. Final hearing will be on 16-12-2013

United Forum with BSNL Management

Talks between United Forum and the BSNL Management took place at 1600 Hrs on 18-10-2013. In that meeting our issue is raised by Forum Leaders and the BSNL management positively responded. GM (Estb) Sri R.K.Goyal told that they have already referred to Legal section for concurrence for Regularization of Officiating JTOs.

Condolences

Sri K.Gangadhara Rao Officiating JTO presently working as JTO MDF Vanasthalipuram, Hyderabad expired on 14-10-2013 at 00:20 Hrs due to Cancer. We pay our respectful homage to the departed OJTO. We convey our deep condolences to his family members.

Kerala OJTO delegation met CMD BSNL

On 10^th Oct 13 Sri Suresh Kumar, Sri Harilal, Sri Pushparajan and other office bearers of BSNL OJTO Kerala met Sri R.K.Upadhyaya CMD BSNL at Trivendrum after the closing ceremony of All India BSNL Foot Ball Tournament and discussed about our Regularization Issue. There CMD BSNL pointed out that your OJTO delegation led by Sri Kabeerdas is already met at New Delhi on this issue. He responded positively and assured to peruse the issue.

07-10-2013

I)                Our delegation Sri N.Kabeerdas, Sri Y.Ramakrishna Rao and Sri U.Kanaka Raju met Smt Rani Chabhra at her chamber in Supreme Court of India and discussed about the

1)  Case OA 1467/2013, MA 1333/2013 about reserve the Officiating JTO vacancies. And also discussed about the MA for reserving the vacancies for all the Officiating JTOs and qualified TTAs. This case is to be heard on 24-10-2013. But due to non filing of counter affidavit by the BSNL Management this may take another adjournment.

2)  Regarding FR22 (1) a (1) : Honorable Supreme court of India passed the order but implementation delay in Corporate office. Due to the  non implementation of the order from 2005 for all the officiating JTOs we are filing contempt petition in PCAT New Delhi.

3)  For the MA regarding Reservation of vacancies and FR22 (1)a(1) contempt petition signing and Advocate advance fees payment process completed.

II)            Our delegation met all the senior officers in Corp[orate office Establishment and Legal Section including Sri A.K Sing AGM Pers-VI for perusing our Regularization issue.

08-10-2013

I)                Our delegation Sri N.Kabeerdas, Sri Y.Ramakrishna Rao and Sri U.Kanaka Raju met GM (Estb) Sri R.K.Goyal along with Sri Prahlad Rai GS AIBSNLEA and discussed about Regularization issue nearly about 30 Minutes. As per the GM (Estb) the Legal openion is asked from BSNL Councils Sri R.D.Agarwala New Delhi and Sri Anil Rathi Panjab and Haryana High Court. As per the Anil Rathi’s openion Establisment section is moving the file to GM Legal section for Regularization of OJTO’s through Supernumararay posts. After completion of the process in the Legal section this file will go to Management Committee Meeting for approval (This meeting will be conducted ones for a week). After Management Committee approval this will go to Board Directors Meeting for Approval ( This Meeting will be conducted ones for Two or Three Months). GM (Estb) said that let us hope for all the process to complete by the year end or in the starting of the 2014. First time GM (Estb) responded positively regarding our Issue.

II)            Our delegation met Sri Sebastian GS SNEA. Sri G.L Jogi and other office bearers of SNEA in CMD office and given representation. They responded positively.

III)        Our delegation Sri N.Kabeerdas, Sri Y.Ramakrishna Rao and Sri U.Kanaka Raju met CMD BSNL Sri R.K.Upadhyaya by taking the appointment. Due to the urgent meetings finally called us by 18:40 Hrs. WE explained latest position of our issue and given representation. He responded positively and directed the Director HR/Enterprises to take necessary steps for Regularization of Officiating JTOs / Qualified TTAs.

09-10-2013.

I)                Our delegation met Sri Sunil Bhat Deputy Manager to MOS for communication and IT Smt Killi Kruparani at Electronics Niketan, CGO Complex through Sri Narasimha Raju OJTO Bhimavaram. We discussed about the latest poison of our issue and given representation. He said that this matter is under consideration of Madam and a file is sent to CMD BSNL office on this issue, they are waiting for reply  from CMD BSNL office. He assured that they will peruse the matter seriously and to use their office at any time regarding settlement of this issue.

II)            Our delegation also met Sri Nagi PA to Minister for Comm. & IT Sri Kapil Sibal at Sanchar Bhavan through Sri Gurumurthy OJTO, Tirupathi. We discussed about our issue and given representation. He responded positively and assured to peruse the matter.

III)          Our delegation met Sri Namboodri President BSNLEU at Dada Ghosh Bhavan and discussed about our issue nearly One Hour. He said that all the Unions and Associations are positive regarding our issue and perusing. He assured that our issue will be discussed in the Meeting with the Management on 11-10-2013.

IV)        Our delegation met Sri Chandeswar Sing GS NFTE, Sri Islam Ahmed and Sri Raja Mouli at their office and discussed about our issue nearly One Hour. They are all responded positively and said that they already discussed our matter about 15 Minutes in the Management Meeting with NFTE held on 08-10-2013. The Management replied that process is started after receiving the BSNL Council opinion. They  said that they have already kept our issue in the item no 10 in the National Council Agenda submitted by them.

V)         Our delegation also met Sri A.N.Rai Director HR/Enterprises and discussed about the latest position of our issue. He responded positively and assured that the Regularization process will be done as early as possible.

Our Central Coordinator Sri Kabeerdas Brother-in-law suddenly expired on 28-09-2012 at night 12:30 Hrs. Due to this reason he could not attend the All India conference of BSNLOA at New Delhi. Next program will be intimated soon.

Regularization of offg. JTOs: We requested to take immediate steps for regularization of offg. JTOs. GM(Estt.) mentioned that legal opinion for creation of super-numeric posts has been sought from BSNL's advocates Sh. R.D. Aggrarwala, Sr. Advocate and Sh. Rathi, BSNL's Advocate in Harayana Circle and their legal opinion is awaited. However,  he mentioned that orally Sh. Rathi Advocate told that creation of further super-numeric posts may not be advisable Hence, after receiving the legal opinion in writing, some other steps will be taken for regularization of Offg. JTOs immediately.

Regularization of officiating JTOs:

GM(E) informed that the legal opinion is against creation of supernumery posts. So other alternatives are under the consideration of the Management like one time upgradation, amendment in RR as a onetime measure to make them eligible for JTO promotion etc. Assn opined that one time upgradation affect their career as they may not get promotions in the future and the second option will be the best available option.

All India Conference of BSNLOA going to be held on 29-09-2013 and 30-09-2013 at T-15, Atul Grove Road, New Delhi. JTO (O) Association News regarding Regularization of Officiating JTOs.

We came to know that BSNL Management asked the Legal section for Legal Opinion regarding Regularization of Officiating JTOs through Super Numerary / Personal Up gradation. Legal Section forwarded the issue to Sri R.D Agarwala BSNL standing council for Legal opinion. The Legal opinion is yet to be received from Sri R.D.Agarwala. Our delegation is going to Delhi shortly to meet the BSNL Management to speed up the issue. Please don’t trust rumors.

Sri Prhlad Rai GS AIBSNLEA is also perusing the issue and going to write a letter to the CMD BSNL to speed up the legal issue and issue of Regularization orders through Management committee.

On the eve of Sri Krishna Janmastami we hope that our Regularization orders will be issued soon. This is because of the sincere and restless efforts made by the Officiating JTOs Association. NFTE GS WRITES TO CMD BSNL REGARDING REGULARIZATION OF OFFICIATING JTOs

LATEST POSITION OF OJTOs REGULARIZATION

It is learned from reliable sources that our file already moved for creation of supernumerary posts. Now it is with GM(Legal). Then will be send to Management Committee. We hope that the supernumerary posting order will be issued soon. We have requested to create the supernumerary order in continuation to the already existing 3500 posts. The seniority would be fixed according to the position in the combined waiting list. We believe that this is the only one practicable solution at this juncture and would be an amicable compromise with out provocations to other groups of employees.

WHY SUPERNUMERARY POSTING..??

1)     It is true that there were 11326 out side quota vacancies in DoT during the formation of BSNL. Diverting these vacancies for up gradation of OJTOs may attract new court cases resulting further delay of our posting.

2)     We fear that further delay will be resulted if we go for amendment of RR 2001. Amendment of RR 2001 with ‘deemed to have been qualified’ is a good but rather old concept.

At  this present scenario no one can file and get admit a case against ‘Supernumerary posting’. OJTOs Association Circle Co Coordinators from all over India have preferred ‘Supernumerary posting’, soon after receiving the disposal order of COCP. BSNL top management has agreed to this suggestion and file is in front of GM ( Legal ) and after getting approval from management committee order will be issued within days. So our OJTO friends are requested to have discussion with our association leaders before they go for individual adventures attempts. It has come to the notice of the association that such irresponsible and    dangerous attempts are being done knowingly or unknowingly by some of our OJTO friends.Such friends are once again requested to stop it immediately to avoid further delay in our posting.We have taken a lots of pain and spend a large amount of money to get the case filed by Kerala OJTOs  admitted in Hon’ High Court of Punjab and Haryana to dispose COCP according to our interests. The COCP was not simply dropped as what is believed by others. It was a long fight. Four delegates from AP headed by Mr. Kabeerdas were eye witness for the final legal war on16/07/2013 in that court. The petitioners tried their level best to continue the COCP projecting many reasons like Karnataka exam stay, Result stay in many circles, Earlier finding of the same court of contempt on supernumerary posting etc.. some how we could overcome all this hurdles. Now every one is bound to show maturity to make use of it.

PENSION IN JTO CADRE
A right for officiating employees.

Officiating JTO’S who were denied officiating arrangement in the last month of retirement and were disbursed with retarial benefits in the TTAcadre, successfully challenged their illegal reversion and denial of retirement benefits from the JTO cadre. 

In the Original Applications 896/2012, 961/2012 filed by Sri P.K.Valsan(Wayand) and Sri,K,M,Gaghadharan (Trissur)respectively through Adv.V. Sajith Kumar, the Honourable Central Administrative  Tribunal by order dated 16/5/2013 declared that applicants are entitled to fixation of pension and other terminal benefits based on the last pay drawn as JTO. Consequential directions also issued.

Attention:  There arevarious such victims waiting for justice in Kerala Circle.  Please take notice of the above orders of the Honourable CAT.

Sub: Regularization of officiating JTOs reg:-

Sir,

Regularization of about 1500 officiating JTOs has been one of the long pending issues raised by this Association. This Association suggested various options, including one time upgradation of posts, creation of supernumerary posts etc. to resolve the issue. About 3500 JTOs have so far been regularized by diverting equal number of posts from direct recruitment quota of JTOs. 

Since 2004, SNEA(I) has been demanding regularization of all the officiating JTOs by upgradation of posts as a onetime measure in order to avoid litigations. But management continued diversion of posts to regularize officiating JTOs. Diversion of posts from DR quota and non conduction of LICE for the 35% and 15% quota was challenged in Hon Chandigarh court resulting in prolonged litigations.

However, recently the contempt petition at Hon High Court of Chandigarh was dropped since the LICE for rect to JTO cadre under 35% and 15% quota was held by BSNL, and, as of now, there is no legal hurdle in resolving the issue. As per the direction of Hon Ernakulam HC, LICE for JTO rect under 35% and 15% quota was held on 02.06.2013. About 25% of the officiating JTOs also appeared in the LICE held on 02.06.2013. So, the number of offtg JTOs to be regularized will come down further once the LICE results are declared by the Circles. Since the LICE for JTO rect is already held, the regularization of remaining officiating JTOs will not create any seniority issue in the future. In all the Circles, hundreds of JTO posts are vacant since no rect against 50% dept quota was done since 2000. As such regularization of offtg JTOs will not make any impact on the promotional avenues of internal candidates like TTAs, Sr TOAs etc towards the 35% and 15% quota.

Considering all the above facts, the regularization of the remaining officiating JTOs may be considered sympathetically as all of them are officiating in the JTO cadre for so many years. This can be easily done by onetime upgradation/creation of supernumerary posts.

After long time the BSNL assured and moving Regularization process by taking Legal opinion. Our delegation also met Hon’ble Minister of Communication for speed up Regularization process.
